FLEGT in Malaysia

Serious outstanding issues must be resolved before a VPA can be signed. These include recognition of native customary rights and a stakeholder consultation process which is of major concern as it is failing to bring consensus or deal with long standing conflicts. The problem is most stark in the Malaysian State of Sarawak, which holds a large amount of the country’s forests, has a majority of indigenous peoples, and is home to over 150 court cases involving land claims.

In this short briefing Client Earth explains the key elements of the EU Timber Regulation which entered into force on 3 March 201 and makes it illegal to place timber on the EU market, if logged in violation of the laws in the country of origin.The EUTR is one component of the EU’s Forest, Law, Environment, Governance
and Trade Action Plan and it is the responsibility of each of the 27 Member States to enforce it.

Un groupe d’ONG européennes et de pays partenaires APV ont conjointement commandé une étude destinée à évaluer la nécessité d’une Observation Indépendante (OI) et d’une Observation Indépendante des Forêts par la Société Civile (OIF-SC) ainsi que les opportunités qu’elles représentent, en supplément de celle prévue dans les APV. Cette étude aura pour objet d’évaluer le risque pour les AVP de ne pas donner suffisamment de crédibilité au marché européen. Elle évaluera également le potentiel que l’OI et l’OIF-SC ont pour atténuer ce risque.

A group of NGOs from Europe and VPA partner countries have jointly commissioned a study to explore the needs and opportunities of Independent Monitoring (IM) and Civil Society-led Monitoring (CS-IFM) in conjunction with VPAs, and in doing so assess the risk that VPAs fail to provide sufficient credibility in the European market, and the potential that IM and CS-IFM can play to mitigate this risk. This document is the Terms of Reference for the study, which will conclude in March 2013.
